JCM ANALYTICS PRIVACY POLICY

JCM Analytics LLC (“JCMA”) operates the jcma-llc.com website (the “Site”) and provides proprietary Laboratory Information Management System (LIMS) software services via its platform JCMWorks for managing test ordering, sample collection, eligibility verification, billing, and reporting (collectively, the “Services”).

JCMA has established this Privacy Policy to explain to you how your information is protected, collected, and used in connection with the Site and Services.

This Privacy Policy may be updated by JCMA from time to time. JCMA will provide notice of materially significant changes to this Privacy Policy by posting notice on the Site.

JCMA contracts with laboratories and other organizations when providing its Services. Please contact the applicable laboratory or organization if you have any questions about how they use and protect your information when under their control. This Privacy Policy does not affect any of the privacy policies, terms, and/or agreements between our customers and their clients and/or employees.

This Privacy Policy uses the term “Personal Information” to refer to any information about a person which can be used to identify them or to distinguish them from other people. Personal Information includes information like a person’s name, address, phone number, login information to our Services and demographic and health information. We use the term “Business Contact Information” to refer to Personal Information relating to our business contacts (e.g., employee contact information) at a customer, prospective customer, vendor, or business partner.

Information Collected

We collect the following Personal Information:

1.         Name, email, and other contact information received from visitors to our Site who request information about our Services on the Contact Us page or who send us email or connect with us through social media or other means;

2.         Patient and employee information received from customers in connection with the implementation and provision of the Services. For example, customers may provide basic patient or employee information, manually or through integration with patient or employee database management systems, in connection with the Services when they are setting up the Services for use;

3.         Client, patient, and employee information received in connection with our customers’ use of the Services. This includes individuals’ demographic information, medical records (tests ordered and results), medical insurance information, and billing information.

Log Data

When you visit our Site and use the web-based components of our Services, we collect information that your browser sends to us that is called Log Data. This Log Data may include information such as your computer’s Internet Protocol ("IP") address, browser version, pages of our site that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

Cookies

Cookies are files with small amounts of data that are commonly used as an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your computer’s hard drive.

Our Site uses these "cookies" to collect information and to improve our products and services. Such Business Contact Information may be stored in our customer relationship management system and other systems in order to help us run our business.

Companies that assist us in providing Services, such as a hosting provider or a customer service provider, may have access to or receive Personal Information. These companies are authorized to use Personal Information only as necessary to provide these Services.

We will not sell Personal Information to any third party. We may transfer Personal Information to the acquirer of our business, as discussed below.

JCMA may disclose information about its users if required to release reports on usage, product performance, and content execution to person(s) approved under contract to receive such information using the necessary security measures to ensure appropriate access.

Disclosures for Legal Reasons

In certain situations, we may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose Personal Information in response to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.

In addition, we may share Personal Information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Services agreements, or as otherwise required by law.

When we make any disclosure of Personal Information described by this section, we will limit the disclosure to only the minimum amount of information which is necessary and will attempt to ensure that any information we do disclose is kept protected by, for example, obtaining a protective order or by requiring the party to whom it is disclosed to agree to keep the information confidential.

Access and Changes to Your Personal Information

You may determine if we have any of your Personal Information and access, correct, or request deletion of your Personal Information by contacting us through our help desk. Before providing you with any information or allowing you to make changes, we will need evidence of your identity. In addition, certain Personal Information we have can be updated through the Services.

Note that we may not have a direct relationship with individual users of our Services. Such individuals may contact their medical provider, laboratory, and/or employer to determine how to access or correct their Personal Information.

Deletion of Personal Information

We generally keep Personal Information associated with our Services during the period we are providing the related Services and for up to 1 year after our Services end. We will, however, hold it longer if needed to provide the Services to our customer, if we have a legal obligation to keep it for longer, or if we require it to resolve a legal dispute.

We may delete Business Contact Information when we determine that it is no longer useful to us, when required by law, or in accordance with our internal data retention practices and policies.

Service Providers

We may employ third-party companies and individuals due to the following reasons:

  • To facilitate our Services;
  • To provide certain parts of the Services on our behalf;
  • To perform Service-related tasks; or
  • To assist us in analyzing how our Services are used.

Contracted third parties may have access to your Personal Information. This access allows third parties to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

We value your trust in providing us with your Personal Information, thus we strive to use commercially acceptable means of protecting it and we maintain a security program designed to protect Personal Information in our possession, which includes organizational, physical and technical safeguards. JCMA provides secure storage of your information on private network servers not available by direct web addresses, and all user information is encoded and transmitted through session keys to ensure that no one other than JCMA can read the transmitted information.

The Services are password-protected, subscription-only products. Only authorized users are permitted to access them or view the member information relevant to the accounts. We strongly recommend that you do not divulge your password to anyone. We have systems in place to provide secure transmission of your information from your computer to our servers. Only certain authorized JCMA employees can access this information if it is relevant to their job duties.

Links to Other Sites

The Site may contain hyperlinks or "links" to other sites, and other sites may "link" to the Site. Web sites linking to and from the Site may have different privacy practices from the ones described here. Therefore, we strongly advise you to review the Privacy Policy of these websites.

We have no control over and assume no responsibility for the data collection, privacy and information sharing policies and procedures or the content of such web sites. This Privacy Policy applies solely to information collected by the Site and our Services.

Children’s Privacy

Our Services are provided solely by subscription to laboratories and other organizations and are not provided directly to individuals, including any children under 18 years of age. We may process children’s Personal Information in order to provide Services to our customers.

JCMA does not use any information about children under 18 years of age for any marketing or promotional purposes whatsoever, either inside or outside JCMA.

We do not provide any Personal Information about children, regardless of its source, to any unrelated third parties, except as expressly provided by this Privacy Policy.

Acquisitions

If we are acquired, we will provide the acquiror with Personal Information so they can continue to provide our Services and related support and otherwise continue our business. If the acquiror’s privacy policy is substantially different than ours, we will notify our customers.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, we advise you to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately, after they are posted on this page.
